Rental Terms and Conditions – FAQ

PAYMENT
Maine Ski Lodging Co. accepts payments made by Visa, Mastercard, or Discover credit or debit card. A minimum of 50% of the total balance is due upon booking the reservation and the balance is due 30 days prior to the arrival date. 

CANCELLATION POLICY
Reservation cancellations occurring outside of 30 days of the arrival date will be refunded in full, less a $50 cancellation fee. No refunds will be issued within 30 days of the arrival date unless the property is re-booked for the same dates of the original booking at the same total cost. Owner may cancel Guest reservation up until 30 days prior to Arrival Date.

CHECK-IN / CHECK-OUT
Seven (7) days prior to the arrival date, guests are provided all necessary instructions for checking into the property. Check-ins may occur after 4:00pm on the arrival date and check-outs may occur at 10:00am or before on the departure date. Early check-ins or late check-outs must be authorized by Maine Ski Lodging Co. and can be confirmed during the week of the arrival date.

AGE / GUEST OCCUPANCY
Guest responsible for booking the reservation must be 25 years of age or older and present during the entire reservation. Property is limited to the maximum occupancy stated on the property listing. No exceptions to either of these policies can be accommodated.

HOT TUBS AND POOLS (FOR PROPERTIES WITH POOLS AND HOT TUBS ONLY)
It is the Guests responsibility to read, understand and follow all provided instruction. Only guests staying at property may use the hot tub or pool. Please shower before use and do not put oils, lotions or any fragrance in the hot tub or pool, as it will clog the filter and make the water dirty and cloudy. Please note that the hot tub is not a swimming pool or a babysitter. We strongly recommend that children not enter the hot tub. If children are allowed in hot tub or pools, they must be monitored by an adult at all times and we strongly encourage limiting their use.

For properties with association maintained hot tubs and pools:
Association maintained hot tub and pools, commonly found at slopeside accommodations such Brookside, Cascades, Locke Mtn., Sunrise, White Cap, etc. are checked daily to ensure water is clean, chemicals are at the correct level and water is at the correct temperature. In rare circumstances, hot tub and pool may malfunction and become unusable prior to the arrival date or during the reservation. If the hot tub or pool malfunctions prior to the arrival date or, during guest stay, and is not immediately repairable, Maine Ski Lodging Co. is not responsible for the guest relocation to alternate accommodations or any refund to guest. Hot tub and pool operation schedule is determined by the individual condominium association and vary throughout the year. Maine Ski Lodging Co. is not responsible for the water temperature and operation schedules for hot tubs and pools.

For properties with privately maintained hot tubs and pools:
Hot tubs will be checked prior to the arrival date to ensure water is clean, chemicals are at the correct level and water is at the correct temperature. In rare circumstances, hot tubs may malfunction and become unusable prior to the arrival date or during the reservation. If the hot tub malfunctions prior to the arrival date or during a reservation and is not immediately repairable, Maine Ski Lodging Co. will notify guest and provide a $75/night reduction in lodging for each night of non-use. Guest must notify Maine Ski Lodging Co. that the hot tub has malfunctioned and allow for the opportunity for Maine Ski Lodging Co. to repair hot tub prior to issuing nightly rate reduction. During the reservation, after each use, and prior to departures, to ensure water levels stay above the jets at all times and cover is securely snapped into place and any additional supplied weights are placed on the cover. There are no scheduled hot tub cleanings during reservations for privately maintained hot tubs.

In consideration for the utilization of the hot tub provided at the Property, Guest understands and agrees as follows:

1.    To the best of guests knowledge, guest is physically sound and has medical approval by guests doctor to participate in physical exercise activities of the type normally engaged in a voluntary for usage of a hot tub.
2.    Guest understands and agrees that guest is responsible for learning how to use the equipment properly and safely. Should instruction be offered, guest holds responsibility for any potential injuries that may occur.
3.    Property owner, property / hot tub manager and Agent are not liable for any loss or damage to guests property arising out usage of the hot tub.
4.    Guest understands that risk of injury and/or illness is present when engaging in or utilizing hot tubs and assumes all responsibility and risk of participation of this program for Guest, guests family and all others staying at the property.
5.    IN CONSIDERATION OF THE ACCEPTANCE OF THIS AGREEMENT, THE UNDERSIGNED INTEND TO BE LEGALLY BOUND FOR MYSELF, MY HEIRS, EXECUTORS, AND ADMINISTRATORS AND DO HEREBY RELEASE ANY AND ALL SPONSORS OF THIS LODGING FACILITY AND THEIR REPRESENTATIVES, SUCCESSORS, AND ASSIGNS, FROM ANY AND ALL LIABILITY ARISING FROM INJURIES, INCLUDING ILLNESS AND DEATH, THAT MY FAMILY, GUESTS OR I MAY SUFFER AS A RESULT OF MY USAGE.
6.    MY SIGNATURE ON THIS AGREEMENT IS EVIDENCE I SHOULD CHECK WITH MY DOCTOR TO SEE IF HOT TUB USE IS SUITABLE FOR ME AND MY CHILD/FAMILY/GUESTS/WARD’S HEALTH AND PHYSICAL CONDITION.
7.    I HAVE CAREFULLY READ THIS AGREEMENT, RELEASE & WAIVER LIABILITY, AND I KNOW ITS CONTENTS. I ADMIT RECEIVING AND ACKOWLEDGING HOT TUB SAFETY RULES ABOVE.

PROPERTY KEYS
Two entrance keys or an electronic combination for the property will be provided to the guest. Additional keys for pools, common areas and lockers will be provided as applicable. Guest will be charged a $75 lock-out fee for lock-out calls on weekdays after 5pm or at any time on weekends. Guest will be charged a $200 fee for any missing key(s).

INCORRECT NIGHTLY RATES
Agent retains the right to cancel Guest reservation within 24 of receiving reservation should Agent determine Property has been rented at an incorrect nightly rate. Should Agent cancel Guest reservation, Agent will provide to Guest a refund of all monies paid.

PETS
Pets are not allowed at the property unless property has been designated as pet friendly. No exceptions to this policy can be accommodated. Pet friendly designations can be found on the individual property listing on the Maine Ski Lodging Co. website. Evidence of pets at non-pet friendly accommodations will result in immediate removal without notice and forfeiture of all amounts paid and may result in guest being charged additional cleaning fees. Slopeside Sunday River condominium associations such Brookside, Cascades, Locke Mtn., Sunrise, White Cap, etc. are not pet friendly for short-term guests and no exceptions to this policy can be accommodated.  

SUBLETTING
Property may not be sublet by guest. Subleasing will result in immediate removal without notice and forfeiture of all amounts paid.

SUPPLIES
Property will have a start-up supply of consumables (paper towels, toilet paper, garbage bags, hand soap and dishwashing detergent etc.), guest is responsible to replenish this supply to their needs during their stay at their expense including propane or charcoal for properties with grills.

SERVICE REQUESTS 
Maine Ski Lodging Co. shall respond to service requests for televisions, cable/satellite programming, WiFi, appliances, other entertainment amenities etc. as quickly as reasonably possible which sometimes could be during the following day. Neither Maine Ski Lodging Co. nor the property owner shall issue rebates or refunds to guest for any operational failure of any of the above amenities, as Maine Ski Lodging Co. shall make a reasonable good faith efforts to ensure the property is maintained to the highest standard.

LINENS
Property beds will be made with clean sheets prior to the arrival date including enough towels, washcloths, pillows and blankets to accommodate each guest.

NOISE / SOCIAL GATHERINGS (AKA PARTIES)
For the enjoyment of all guests and neighbors, please be courteous and aware of noise levels at all times. Large social gatherings and/or parties are prohibited from occurring at the property and may result in immediate removal without notice and forfeiture of all amounts paid and may result in additional cleaning fees. Noise levels should be reduced between the hours of 10:00pm and 9:00am. Guest will be charged a $75 fee for each noise complaint reported to Maine Ski Lodging Co.

FIREWORKS / SKY LANTERNS
Fireworks and sky lanterns present a fire and safety danger and are prohibited from all Agent managed properties. Fireworks and sky lanterns may violate local ordinances. Guest will be immediately evicted without refund if found to be using fireworks or sky lanterns or be charged a $500 fee if evidence of fireworks is discovered after Guest departure.

FIREARMS / WEAPONS
Firearms and other weapons of any kind are prohibited from the Property. Discharging a firearm will result in immediate eviction without refund.

LOCKED AREAS
Locked closets, rooms and other storage areas at the property for which guest is not provided key shall be off limits to guest.

POLICE ENFORCEMENT
Any police enforcement actions by the town, county or home / condominium association may result in immediate removal without notice and forfeiture of all amounts paid.

CONSTRUCTION AROUND PROPERTY
Maine Ski Lodging Co. and property owner are not responsible for any reimbursements or relocation of guest to an alternative property due to construction in the vicinity of the Property.

SMOKING AND VAPING
Inside all Maine Ski Lodging Co. managed properties are smoke and vape free. Evidence of smoking or vaping of any kind inside the property will result in immediate removal without notice and forfeiture of all amounts paid. Additional cleaning fees and anything additional needed to return the property to its original condition will be charged to the guest. If guest engages in any smoking activities at the property, guest must do so outside and away from decks, porches, open windows, doors etc. and is responsible to fully extinguish all smoking materials. Guest is responsible to pick up any smoking related debris (cigarette butts, wrapping papers, matches etc.) from outside property. Failure to pick up this debris will result in guest being charged a $75 fee.

SKI-IN / SKI-OUT
Properties advertised as ski-in / ski-out are located at Sunday River Resort and are designed to be accessible by skis provided there is enough snow. Please be aware that Maine Ski Lodging Co. or property owner cannot control snowfall amounts, natural or artificial, and if the property is not ski-in / ski-out due to weather conditions or resort closure, lack of snow or other obstruction, Agent is not responsible for any refund.

PRIVATE SEPTIC SYSTEMS
No cooking oil or grease can be put down the sink. NOTHING BUT TOILET PAPER can be flushed down the toilet. DO NOT FLUSH feminine products, wipes (even “flushable” wipes), food, coffee grounds, cigarette butts, condoms, medicine, grease, oil, paint, bleach or other chemicals of any kind. Use only the laundry detergent provided when using the machines. Follow all guidelines for the use of the Septic System provided on reminder signs in bathrooms and kitchens.

PARKING / DRIVEWAYS
Some driveways and roads are steep and may be difficult to travel on during the winter months and may require 4-wheel drive and/or winter tires to access the Property. Driveway plowing and sanding is done by an independent snow removal company and because of this, Agent cannot expedite plowing and/or sanding. During winter weather events, plow crews will clear snow from the property as soon as safe and possible. If vehicles are not moved while the plow crew is on-site, they will do their best to plow around vehicles. Plow crews are not available to assist with vehicles stuck in driveways or roadways. For assistance with stuck vehicles, please contact AAA at: 800-222-4357. Sand and/or rock salt and shovels are provided at most properties. 

For properties that require permitted parking, Maine Ski Lodging Co. will provide guest temporary parking permits at the time of check-in. Slopeside Sunday River condominium associations such Brookside, Cascades, Locke Mtn., Sunrise, White Cap, etc. are issued a limited number of parking permits and requests for additional parking permits cannot be accommodated.  

CLEANING / PROPERTY CARE
Guest is required to leave property in the same general condition as found prior to the arrival date. If necessary, excess cleaning fees may be charged to guest after departure. It is appreciated by the cleaning staff if property is equipped with washer and dryer to start a load of towels and the dishwasher if applicable. 

TRASH REMOVAL
For non-condominium properties, guest must bag all trash and leave in supplied outdoor trash bins. If outdoor bins are not accessible or available, guest must leave trash bagged and next to property entrance. For condominium properties, guest is responsible to dispose of trash in parking dumpster generally located in condominium association parking lot.

DAMAGES
Upon arrival, if guest notices any damage to the property, guest is required to immediately notify Maine Ski Lodging Co. Any and all damage caused by guest is the full responsibility of the guest.

INTERFERENCE 
Neither property owner nor Maine Ski Lodging Co. shall be liable for events beyond their control which may interfere or disrupt guest(s) occupancy, including but not limited to acts of nature, governmental agencies, fire, strikes, war, inclement weather and/or construction noise from nearby sites. NO REBATES, CONCESSIONS OR REFUNDS will be offered.

TRANSFER OF PROPERTY OWNERSHIP
In the event ownership of the property is transferred from owner by any means prior to or during the rental period, the following shall apply: property owner may but shall not be required to assign this agreement to the new owner, and if not so assigned, Maine Ski Lodging Co. may in its sole discretion provide guest with a comparable rental property. If, as determined by Maine Ski Lodging Co., no such transfer to a comparable property is possible, Maine Ski Lodging Co. shall return all monies previously tendered by you; and you agree that property owner and Maine Ski Lodging Co. shall have no other liability to you.

CAUSE FOR IMMEDIATE REMOVAL WITHOUT NOTICE
Guest will be subject to immediate removal without notice from the property if they violate any terms of this agreement, including but not limited to; violation of occupancy limits, pet provision, smoking, noise disturbances or fireworks. In the event of removal without notice from the property, guest must vacate the property immediately and forfeit any and all amounts paid.

LIABILITY AND HOLD HARMLESS
Guest agree to defend, indemnify and hold harmless Maine Ski Lodging Co. and represented property owner from and against all claims, demands, loss, liability of any kind and character, including cost of defense, arising out of or in any way connected with guests use of the property in the event guest or guest of guest suffer personal, physical, property damage, injury, or loss. Maine Ski Lodging Co. and property owner are not responsible for lost or stolen items in or around the property.

CORONAVIRUS/COVID-19 WAIVER OF LIABILITY
Guest acknowledges the contagious nature of COVID-19 and voluntarily assume the risk that Guest may be exposed to or infected by COVID-19 by leasing the Property, and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. Guest voluntarily agrees to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and/or death), illness, damage, loss, claim, liability, or expense of any kind that I incur in connection with the rental of the Property. Guest hereby agrees to hold harmless the property owner, its employees, Agent, agents, and representatives from all claims, liabilities, actions, damages, costs or expenses of any kind arising out of or relating thereto. Guest understands and agrees that this release includes any claims based on the actions, omissions, or negligence of the property owner, or its employees, Agent, agents, and representatives, whether a COVID-19 infection occurs before, during, or after my/our rental of the Property.
